By using our AI automation services, you acknowledge and agree to the critical provisions outlined in this document, particularly regarding data confidentiality and liability limitations.

Any data transmitted from the Client to the Company's Service (including but not limited to emails, ticket requests, API calls, account details, and all processed data) is explicitly NOT considered confidential or private. The Client acknowledges that transmitting data to our service constitutes an explicit waiver of any confidentiality claims.

1.2 Client Responsibility

It is the Client's sole responsibility to ensure that no inherently confidential information is transmitted through our Service. The Company bears no liability for data provided by the Client that the Client subsequently claims to be confidential or private.

1.3 No Data Ownership Claims

By using our Service, the Client explicitly waives any claims to data ownership beyond what is necessary for service operation. Processed data may be used for service optimization and AI model training without compensation or notification.

 

2. Information Collection 2.1 Device Information

We automatically collect technical information about your device including:

  • IP address, browser type, and operating system
  • Cookies and similar tracking technologies
  • Usage patterns and service interaction data
  • Referring URLs and search terms
2.2 Order Information

When purchasing our services, we collect:

  • Business name and contact information
  • Billing and payment details (processed securely)
  • Service configuration preferences
2.3 Service Operation Data

During service operation, we process:

3. Data Usage & Processing 3.1 Service Operation

We use collected data exclusively for:

  • Providing and maintaining AI automation services
  • Processing e-commerce operations (order status updates, notes, etc.)
  • Service optimization and functionality improvements
3.2 Strict Purpose Limitation

We contractually limit data usage to the specific purposes outlined in our service agreements. Under no circumstances do we use data beyond these defined operational requirements.

3.3 Automated Decision-Making

Our AI systems may make automated decisions affecting order management and customer interactions. Clients who object to such automated processing must immediately:

  • Uninstall our application from all systems
  • Formally request account closure via registered email
  • Cease all use of our Service

Critical Notice: Third-Party Platforms

When connecting to platforms like WooCommerce, Shopify, or WordPress, the Client assumes full responsibility for compliance with those platforms' terms. Genius Plugin bears no liability for third-party data handling practices.

 

6. Merchant Data Responsibilities 6.1 Merchant Obligations

Merchants using our service must:

  • Obtain necessary consents from their customers
  • Ensure transmitted data complies with all relevant regulations
  • Maintain their own data protection measures
  • Regularly audit their use of our Service
6.2 Processing Notification

We process these categories of merchant data:

  • Platform credentials for service access
  • Order information for automation functions
  • Configuration settings for workflow execution
6.3 Liability Limitations

The Company shall not be liable for:

  • Merchant misuse of our Service
  • Data breaches originating from merchant systems
  • Regulatory violations caused by merchant actions
  • Financial losses resulting from service interruptions

 

7. Client Rights & Responsibilities 7.1 Limited Rights

Clients may:

  • Request access to their account data
  • Correct inaccurate account information
  • Request service termination and data deletion
7.2 Service Termination

To terminate service and request data deletion:

  • Uninstall all Genius Plugin components
  • Submit formal termination request via registered email
  • Allow 14 days for complete data purging
7.3 Dispute Resolution

Any disputes regarding data handling:

  • Must be submitted in writing within 30 days of incident
  • Are subject to binding arbitration in Dover, DE, USA
  • Are limited to direct damages not exceeding service fees paid
